By using our Services, you are agreeing to these terms. Please read them carefully.
Sometimes additional terms or Service requirements may apply. Additional terms will become part of your agreement with us if you use those Services.
Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. We may suspend or stop providing our Services to you if you do not comply with our terms, or otherwise create risk or possible legal exposure for us, or if we are investigating suspected misconduct.
Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services. You retain ownership of any intellectual property rights that you hold in the content that you submit to the Services. In short, what belongs to you stays yours.
Our Services display some content that is not Bindwise’s. This content is the sole responsibility of the entity that makes it available. So that does not necessarily mean that we review content, so please don’t assume that we do.
In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.
By using the Services you thereby indemnify Bindwise, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.
You need a Bindwise Account in order to use our Services. You may create your own Bindwise Account, one and only one. To protect your Bindwise Account, keep your password confidential. You are responsible for the activity that happens on or through your Bindwise Account. Try not to reuse your Bindwise Account password on third-party applications. Bindwise may access your account, or information associated with your account, to provide support or maintenance, for security-related reasons, or any other business purpose. You acknowledge and consent to such access.
We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.
You can stop using our Services at any time, although we’ll be sorry to see you go. Bindwise may also stop providing Services to you, or add or create new limits to our Services at any time. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice.
We provide our Services using a reasonable level of professionalism and we hope that you will benefit using them. In short, we try to keep Bindwise up, bug-free, and safe, but there are certain things that we don’t promise about our Services. We provide the Services “as is”. To the fullest extent permitted by law, Bindwise:
excludes all representations and warranties relating to the Services and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in the Services and/or the Services’ content; and
excludes all liability for damages arising out of or in connection with your use of the Services. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised Bindwise of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
The above exclusions and limitations apply only to the extent permitted by law. So don’t worry, none of your statutory rights as a consumer are affected.
We are committed to protecting your privacy, because it is very important to us. Authorized employees within Bindwise on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers.
There are no hidden fees other than stated in https://www.bindwise.com (Pricing section) and explained herein. You can cancel your subscription at any time.
Bindwise offers two subscription plans to its Services (each, a “Plan”).
Each Plan includes a numerical range of products (“Products”) and competitors (“Competitors”) that may be monitored by our Services on your Bindwise Account in any given month of the subscription period.
You may link your Amazon® accounts from any marketplace to the Bindwise Account. One Plan allows you to link all marketplaces to the Account. If there is a repetition in linked marketplaces, the maximum number of the same linked marketplaces determines the amount of Plans you are subscribed to.
For example, one Plan gives you a possibility to use our Services for Amazon® US, Canada, Germany, Spain, France, Italy, UK, India, Japan and China marketplaces. If you would like to use the Services twice for US marketplace (because you have two different shops on the marketplace) - you will be subscribed to two Plans.
To view the specific details of your Plan, including amount of subscribed Plans or the next billing date, login to your Account on the Bindwise Website and click the “Subscriptions” page or contact us at firstname.lastname@example.org.
Your convenience is the highest priority for us, so in case of the plan downgrading or upgrading we will give you an explicit notice in the Account.
The fees for your Plan are billed in advance of each billing cycle. In the event you cancel your Plan, refunds will be provided for partial or unused months of the Services.
If you upgrade your Plan level, you will immediately be charged for the increased price of the upgraded Plan, prorated to reflect the remaining duration of your subscription period, and you will be charged the full amount of the then-current rate for the new Plan, as provided at https://www.bindwise.com (Pricing section), beginning with your next billing cycle.
If you downgrade your Plan level, you will have a negative balance stated in your Account, which will be subtracted (prorated) from the full amount of the then-current rate in the very next billing cycle. Afterwards, next billing cycles will have the then-current rate without a proration. But be aware that downgrading your Plan may cause the loss of Account content, features, or capacity. Bindwise disclaims liability for any such loss. If don’t want the downgrading proration for the next billing cycles, but instead, to receive refunds for downgrading your Plan level prior to the end of your subscription period, please provide written notice to email@example.com.
